Buccaneer Energy signs LOI for farmout of Alaska assets

Buccaneer Energy Limited advise that a non binding Letter of Intent ("LOI") has been executed with a US based public company ("Farm-In Party") to farm-out the following projects that are currently 100% owned by the Company:

  • Southern Cross Unit;
  • North West Cook Inlet Unit; and
  • North Cook Inlet Unit - Deep Oil Rights.

The Farm-In party will pay 100% of the costs associated with two wells in each of the above projects for which it will earn a 49% working interest.

In addition the Farm-In Party will be granted an option to earn a 49.0% working interest in the Company's 100% owned onshore West Eagle project by paying 100.0% of the costs of the first two wells.

Buccaneer will retain a 51.0% working interest and the role of Operator in all of the above projects.

Additionally, the Company will retain its existing working interest in both the Kenai Loop Project (100%) and Cosmopolitan Project (25%).

The LOI contemplates that on completion of the above wells and the assignment of a 49.0% working interest to the Farm-In Party that all future expenditure on the above projects will be based on individual working interest ownership.

The LOI stipulates that the Endeavour jack-up rig must be used on all off shore drilling that is subject to this LOI.

The LOI provides the basis for the parties to negotiate and if agreed, execute, a binding Exploration and Development Agreement ("Agreement") at which time further details will be disclosed. The LOI acknowledges that the proposed transactions will be subject to satisfaction of conditions, including board approval by both parties. The LOI will automatically terminate on 15 September 2013 if an Agreement has not been executed and either party may withdraw from the LOI at any time.

If the Farm-In party proceeds to drill all 8 wells subject to this LOI, total expenditure by the Farm-In Party is expected to be between US$150.0 - US$200.0 million.

Giant superconducting ring takes a road trip

It looks like an alien spaceship about to take off on an intergalactic adventure. In reality this gargantuan object is a ring of superconducting magnets made by human hands, but its current journey is as bizarre as any a spacecraft might make.

The 15-metre-diameter ring was originally used at Brookhaven National Laboratory in New York to measure the magnetism of the muon, a subatomic particle that is essentially a heavier version of the electron. Now researchers at Fermilab in Batavia, Illinois, want to use it for a new experiment called Muon g-2. The only problem is moving it to its new home, about a third of the way across the US.

You can't just stick the ring in the mail, even if you could find a big enough stamp: so delicate is the wiring inside that even tiny disturbances would wreck it. That's why the ring has to move at a snail's pace on a specially designed truck. No one would want to get stuck in traffic behind this monster, so it only brought the ring to a nearby marina. There it was transferred to a barge, which is now sailing down the east coast.

The barge will round the tip of Florida before eventually chugging up the Mississippi river to Illinois, where the truck will take over again for the last leg of the journey. That's some detour.

The woman who took on DOMA

The Supreme Court's landmark decision to overturn the Defense of Marriage Act (DOMA) is much more than a symbolic victory for 84-year-old Edith Windsor, the plaintiff in the suit.

In 2009, Windsor's partner of 40 years, Thea Spyer, died after a battle with multiple sclerosis. Spyer left her estate to Windsor, but because their marriage was not legally recognized, Windsor was charged $363,053 in estate taxes.

Windsor first sued the United States in November 2010, arguing that DOMA was unconstitutional. In June 2012, the U.S. District Court for the Southern District of New York ruled in favor of Windsor. The case then went to the Second Circuit Court of Appeals. The panel ruled 2-1 in favor of Windsor.

With the Supreme Court's decision to strike down DOMA with a 5-4 ruling, Windsor will finally be eligible for a tax refund, plus interest.

Windsor heard the news of the court's decision while at her lawyer's home, according to the New Yorker. The room, which was filled with family and friends, erupted in cheers when the news of the ruling came down.

President Obama called Windsor to congratulate her on the victory.

"Hello, who am I talking to?" Windsor said, according to the New Yorker. "Oh, Barack Obama? I wanted to thank you. I think your coming out for us made such a difference throughout the country."

The president also spoke with the plaintiffs in the case against the legality of California's Proposition 8, which banned same-sex marriage in the state.

Former President Bill Clinton, who originally signed DOMA into law in 1996, and former Secretary of State Hillary Clinton released a joint statement applauding the Supreme Court's decision.

"By overturning the Defense of Marriage Act, the court recognized that discrimination towards any group holds us all back in our efforts to form a more perfect union," the statement reads. "We are also encouraged that marriage equality may soon return to California. We applaud the hard work of the advocates who have fought so relentlessly for this day, and congratulate Edie Windsor on her historic victory."

At a New York City press conference following the ruling, Windsor was modest about her role in history and status as an icon in the gay rights movement.

"It's an accident of history that put me here," said Windsor. "If Thea had been Theo," things would have been different, she said.

"What a way to celebrate the life of my beloved Thea," she said.

(AP) ? A Chinese space capsule with three astronauts landed safely Wednesday on the country's northern grasslands after a 15-day trip to a prototype space station, marking the latest success for China's manned space program as it enters its second decade.

The Shenzhou 10's descent module landed by parachute in the vast territory of Inner Mongolia early Wednesday with the three crew members smiling and waving on live television after wriggling through the blackened capsule's narrow hatch.

"Space is our dream, the fatherland is our home. Thanks to all compatriots who supported us and best wishes for the wealth and success of our fatherland and the ever greater happiness of our people," mission commander and two-time space traveler Nie Haisheng said to the cameras.

Wang Haiping, China's second female astronaut to complete a mission, said the trip had been especially worthwhile for the opportunity to conduct China's first science class in space, beamed live to 60 million schoolchildren across the country.

"I hope all our young friends may wish beautiful dreams and may their dreams come true," said Wang, who, like her two colleagues, was still clad in her space suit and seated under bright sunshine in white folding chairs in front of the round-edged module.

Back at the Beijing command center, manned space program director Zhang Youxia declared the mission ? China's longest to date ? a "complete success" and said all three astronauts were in perfect health.

He was followed by the Communist Party's seventh-ranked official, Zhang Gaoli, who conveyed congratulations from the party leadership and declared that the manned program was entering a new and more challenging stage.

The program has "tremendous significance for the advance of our country's economic and technological strength and ethnic unity, and displays the great Chinese path, spirit and power," Zhang said.

China's military-backed space program is a source of massive national pride, and the successful mission stands as the latest milestone in the party's smooth consolidation of support under its new leader, President Xi Jinping, who also commands the armed forces.

China sent its first astronaut into space in 2003, becoming the third nation after Russia and the United States to achieve manned space travel independently, and has powered ahead in a series of methodically timed steps. Meanwhile, the American program, now in its sixth decade of putting people into space, routinely works on the International Space Station and has long-term plans to go to an asteroid and Mars.

The latest Chinese mission was the second crewed trip to the Tiangong 1 experimental space station, launched in 2011. It's due to be replaced by a three-module permanent station, Tiangong 2, seven years from now.

The future station will weigh about 60 tons, slightly smaller than NASA's Skylab of the 1970s and about one-sixth the size of the 16-nation International Space Station. China was barred from participating in the ISS, largely because of U.S. objections over political differences and the Chinese program's close military links.

Work on Tiangong 2 is going according to plan, and the station's laboratory module should be launched around 2015, another leading manned space program official, Wang Zhaoyao, told a news conference Wednesday. He said its core module would be launched around 2018 and the entire station assembled by 2020.

Alongside the manned program, China is developing the Long March 5 heavier-lift rocket needed to launch the Tiangong 2. It also plans to send a rover to the moon, possibly followed by a crewed lunar mission if officials decide to combine the human spaceflight and lunar exploration programs.

Space telescope funded by public donations meets $1 million goal

Public donors giving between $10 and $10,000 each have hit a $1 million crowdfunding goal for ARKYD, the pint-size space telescope that can be used by schools and enthusiasts alike.

The first space observatory paid for in part by public donations has hit its initial $1 million fundraising goal, putting the project on track for launch in 2015.

The telescope, dubbed ARKYD, is a munchkin compared with the venerable Hubble Space Telescope or its successor, the James Web Space Telescope. ARKYD's light-gathering mirror is only about 8 inches across, compared with Hubble's 13-foot mirror or the 21-foot mirror of the James Webb telescope, slated for launch in October 2018.

But ARKYD holds the potential to offer something these others don't ? time on an orbiting observatory for anyone from an elementary-school student to professional scientists whose research goals range from studying asteroids to hunting for planets outside our solar system.

The project is the first step toward Planetary Resources, Inc.'s ultimate aim of mining asteroids. The company intends to incorporate such an instrument into spacecraft that initially would rendezvous with an asteroid passing relatively close to Earth and later reach asteroids farther away.

To that end, Planetary Resources developed ARKYD and its needed support infrastructure, such as a ground station, with money from private investors. But the company was founded by X-Prize Foundation founder and chairman Peter Diamandis and Eric Anderson, both of whom champion broader public engagement in science. Hence the crowdfunding and the benefits that come with donating.

The $1 million mark ensures that a bare-bones telescope will get launched and maintained. And it ensures that the company will be able to deliver what they promised to donors. For instance:

  • A $10 donation "gets you our eternal gratitude" and "a say in how the telescope is used," according to the company's fundraising page on the website Kickstarter.
  • Up that to $25, and you get a "selfie" ? you supply a picture of yourself, they send it to the observatory, and an onboard camera takes a picture of your picture displayed on a small video screen on the telescope's exterior, giving you Earth or space as a backdrop.
  • For $450, you get to pick three targets for the telescope and receive the images that result.
  • Pony up $5,000, and the school or museum of your choice gets 25 targets, in addition to teaching tools that will help incorporate the observations into its science curriculum.
  • For $10,000 (24 people have contributed at this level so far), it's the school support plus extras, including tickets to the launch, among other items.

Now that fundraising has met the company's basic goal, the 10 days remaining in Planetary Resources' drive are devoted to raising more to increase the observatory system's capabilities. A total of $1.3 million would allow the company to build a second ground station to receive data from the craft. This would speed processing and distribution of images. If the company hits the $2 million mark, it will beef up the telescope for planet-hunting purposes.

This holds a special attraction for Sara Seager, a planetary scientist at the Massachusetts Institute of Technology and a member of Planetary Resources' advisory board. The project represents what she terms "a fresh approach" to space science.

It's striving to engage the world with access to an on-orbit observatory, she says. And it's moving in a direction she has been advocating for the field ? smaller and more numerous space observatories.

"I'd like to see a new paradigm for space science, where instead of one big telescope we have a fleet of small telescopes," she adds.

Her students have been working on a prototype for what, in effect, is a telescope in a shoe box. The telescope is designed to hunt for planets around nearby stars. But, she says, it has been hard to get money to launch the prototype, which would piggyback on a rocket carrying a larger, primary payload to orbit.

A small telescope must be incredibly stable to have any hope of detecting an extrasolar planet as it passes in front of its star and dims the starlight briefly. In collaboration with MIT's Draper Laboratory, she says, she, her students, and collaborators have licked that problem.

"By combining forces with Planetary Resources, we may be able to the the job done," she says, referring to orbiting what could be the first of many small space telescopes with this precision-pointing capability.

Wells snaps slump as Yankees rally past Rays

NEW YORK (AP) - Vernon Wells glanced at the scoreboard and noted that the fastball he'd seen well clocked in at 96 mph.

Big slump or not, Wells felt good about his pinch-hit at-bat with the Yankees trailing Tampa Bay in the seventh inning Saturday. So with a confident swing, he smashed a three-run, go-ahead double that carried New York to a 7-5 win over the Rays.

Wells was in a 9-for-87 slide that landed him on the bench the past two days, with rookie outfielder Zoilo Almonte starting in his place. But with the Yankees down 5-4, Wells batted for No. 9 hitter Chris Stewart with the bases loaded and two outs.

"Through his struggles, I think his at-bats against lefties were still pretty good," manager Joe Girardi said. "We just liked the matchup. Vern's been doing it for a long time in big spots."

Wells' drive to right-center bounced above the top of the wall, where it hit a fan's glove and was ruled fan interference.

The umpires allowed all three runners to cross home plate, determining David Adams would have scored from first base if not for the fan interference. They sent Wells back to second, but the Yankees suddenly had a 7-5 lead.

Rays manager Joe Maddon argued that it should have been called a ground-rule double, with only two runs scoring.

"It was good to hit a ball and it not land in somebody's glove," Wells said. "And it came at a great time."

Tampa Bay led 5-3 after top prospect Wil Myers hit a grand slam for his first career home run in the sixth.

Wells' first extra-base hit since May 31 got CC Sabathia (8-5) off the hook after he allowed five runs in seven innings.

"It's frustrating," Sabathia said. "I'm happy these guys came back and were able to overcome that."

Mariano Rivera worked a scoreless ninth for his 26th save.

Meanwhile, Almonte kept up his hot hitting, starting in Wells' place in left field. On Friday night, he went 3 for 4 with a home run. He was 1 for 2 with two walks and three RBIs on Saturday.

"It's not easy at all, but I'm trying my best," Almonte said through a translator. "I feel like I'm seeing the ball really well and I just hope it continues."

David Robertson came on after the Yankees took the lead and pitched a perfect eighth with two strikeouts.

Joel Peralta (1-4) took over for the Rays in the seventh and immediately got in trouble. He loaded the bases with one out on two walks and Lyle Overbay's double, and was pulled for lefty Jake McGee.

McGee struck out Jayson Nix for the second out but walked Adams to force in a run, the second time the Yankees scored on a bases-loaded walk. Adams had never drawn a walk in 86 career plate appearances before Saturday; he had two in the game.

Wells then batted for Stewart, who was 0 for 3 with a double play to end a second-inning threat.

As bad as his numbers looked, Wells insisted he had felt OK at the plate. The time off gave him the chance to work on his swing in the batting cage.

"I never lose confidence," he said. "As soon as you lose confidence, you're done."

The Rays trailed 3-1 when the Yankees intentionally walked Evan Longoria with two outs to get to Myers.

The rookie came in hitting .190 in five games since he was called up from the minors at the beginning of the week. He'd had exactly one hit in four straight games before going 3 for 4 on Saturday in his first start as a designated hitter.

Longoria was 2 for 2 with a double and a solo homer that accounted for the Rays' lone run when the Yankees intentionally walked him. On a 1-2 count, Myers hit a high fly to center. Brett Gardner jumped at the fence and the ball bounced off the webbing of his glove and into the stands, though it appeared to already be over the wall when he touched it.

"It was just awesome to be down two strikes and the crowd cheering and to be able to put a swing like that on it," Myers said. "Just a cool experience."

Rays rookie starter Alex Colome is yet to allow an earned run over 10 innings in two career starts. He gave up three unearned runs, five hits and five walks with three strikeouts in 4 1-3 innings. The Rays handed out a season-worst nine walks.

"Walks really kicked our butt today," Maddon said.

With two outs in the third, Almonte singled on a two-strike count to drive in two runs and give the Yankees a 2-1 lead. He walked with the bases loaded in the fifth.

NOTES: Myers became the first visiting player to hit a grand slam at Yankee Stadium for his first career home run since Detroit's Ricky Peters in 1980. Myers is the second player in club history with a grand slam for that first homer. Jorge Velandia did it in 2007, also against the Yankees. ... NASA's 2013 HS3 hurricane mission to delve into Saharan dust

June 17, 2013 ? NASA's 2013 Hurricane and Severe Storms Sentinel or HS3 mission will investigate whether Saharan dust and its associated warm and dry air, known as the Saharan Air Layer or SAL, favors or suppresses the development of tropical cyclones in the Atlantic Ocean. The effects of Saharan dust on tropical cyclones is a controversial area of science. During the 2012 campaign, NASA's Global Hawk unmanned aircraft gathered valuable data on the dust layer that swirled around Tropical Storm Nadine for several days.

The Saharan dust layer is composed of sand and other mineral particles that are swept up in air currents and whisked westward over the Atlantic Ocean. The extreme daytime heating of the Sahara creates instability in the lowest layer of the atmosphere, warming and drying the air near the surface and cooling and moistening the air near the top of the dust layer near 5 kilometers (16,500 feet). Once it exits the African coast, the dust-laden air moves over air that is cooler, and moister, and it's the temperature inversion of warm air over cold that prevents deep cloud development. This suppression of deep cloud formation along with the dry air within the dust layer is reasons why this Saharan air layer is sometimes thought to suppress tropical cyclone development. On the other hand, the southern boundary of this hot desert air essentially acts like a front whose attendant wind patterns are a major source of the African waves that are precursors to storm formation.

Some Saharan dust has been known to make the journey across the Atlantic and to the U.S. east coast. But Saharan dust doesn't just cause sunrises to appear more reddish, the dust also impacts the development of clouds and precipitation. The dust particles can provide a surface for small cloud droplets and ice crystals to form within clouds. More dust particles means that a given amount of available water is spread onto more particles, creating large numbers of small drops and delaying the formation of larger raindrops. Those effects, coupled with the warm and dry air, have presented challenges to meteorologists who have been trying to understand the effect of Saharan dust on tropical cyclones.

HS3 addresses the controversial role of the Saharan Air Layer, or SAL, in tropical storm formation and intensification by taking measurements from three instruments on board the Global Hawk. These instruments include a cloud physics lidar which uses a laser to measure vertical profiles of dust; a dropsonde system that releases small instrumented packages from the aircraft that fall to the surface while measuring profiles of temperature, humidity, and winds; and an infrared sounder that measures temperature and humidity in clear-sky regions.

On Sept. 11 and 12, during the 2012 HS3 mission, the NASA Global Hawk aircraft covered more than one million square kilometers (386,100 square miles) going back and forth over the storm in a gridded fashion in what's called a "lawnmower pattern."

The SAL was present primarily during that first flight, and again on the flight from Sept. 14 to 15. "The SAL did not act to suppress development on Sept. 11 and 12, at least not in the sense of a direct intrusion into the storm circulation, but it is too early to say what role it might have played in other ways and in other flights," said Scott Braun, HS3 Principal Investigator, at NASA's Goddard Space Flight Center, Greenbelt, Md. "There is some evidence that it (the SAL) was getting into the storm circulation on Sept. 14 and 15, but the extent to which it impacted development is unclear."

The dust data collected by the Global Hawk is important for scientific studies on the SAL. Other data was useful operationally to the National Hurricane Center (NHC), the entity that issues forecasts for tropical cyclones. The forecasters at the NHC used data from dropsondes released from the Global Hawk in the discussion of Nadine at 11 a.m. EDT on Sept. 20, "The current intensity is kept at 45 knots (51.7 mph/83.3 kmh)?is in good agreement with dropsonde data from the NASA global hawk aircraft and AMSU [satellite instrument] estimates."

Valuable data from the Global Hawk dropsondes on September 22-23 provided the National Hurricane Center with information that contributed to their reclassifying the storm as a tropical storm after one day of being called a post-tropical low. Shortly after HS3's last flight into Nadine on September 26-27, Nadine actually strengthened back into a hurricane and reached its maximum intensity.

Dropsonde data from HS3's flight on September 26-27 showed that temperature and humidity conditions in the storm were becoming more favorable for the occurrence of deep thunderstorms. Infrared data from NASA's Aqua satellite on Sept. 28, 2012, revealed that strong convection and thunderstorms did build up again and strengthened Nadine back into a hurricane.

HS3 is a five-year mission specifically targeted to investigate the processes that underlie hurricane formation and intensity change in the Atlantic Ocean basin.

2 bodies found in charred Detroit medical facility

DETROIT (AP) ? A man identified by employees as a former maintenance worker opened fire Tuesday inside a Detroit medical facility, sending workers and visitors screaming and rushing for the doors just moments before the building erupted in flames.

Crews digging through the gutted Park Medical Centers building hours after the fire recovered the remains of a man and a woman, Detroit police said Tuesday night in a release.

Authorities did not release the identities of the dead, pending autopsies, but police had been searching for 35-year-old medical assistant Sharita Williams and the fired maintenance worker, who relatives said was her ex-boyfriend.

Williams' mother, Antha Williams-Hill, told The Associated Press that one of her daughter's co-workers told her that the man threatened her daughter inside.

"He said, 'You think I'm playing with you?'" Williams-Hill said. "He told the other girl, 'I think you better get out of here.' The girl left and said she then heard two shots."

Last week, Sharita Williams was granted a personal protection order against the man, according to Wayne County Court records.

Williams-Hill said two days earlier, someone had emailed her sexually explicit photos of her daughter that also were posted on Facebook. The text accompanying the photos read: "How do you like Sharita's new boyfriend?" her mother said.

Dr. Stuart Kirschenbaum, a podiatrist who operated his private practice from the building for about 30 years, said he heard a security guard yell that the gunman "had taken Sharita and is shooting at other people in the building."

Destroyed in the blaze, Kirschenbaum said, was his collection of boxing gloves, personal letters and photos of boxing great Joe Louis. He estimated the memorabilia were worth about $100,000.

Dr. Kim Logan-Nowlin, a clinical psychologist, said she was driving in for an appointment Tuesday morning when a member of her staff called with this frantic message: "Kim, the building is on fire. They're shooting."

Dwane Blackmon, Detroit police homicide inspector, declined to identify the maintenance man as the suspect but said everyone else inside except the woman and male suspect appeared to have escaped the blaze.

Investigators were unable to quickly go deep into the one-story building, described by tenants as also having a basement, due to fears of the structure's integrity.

Williams-Hill said she was asked to go to the coroner's office to identify whether the deceased woman was her daughter "because of the condition of the body."

She said her daughter had been dating the married maintenance man for more than a year, but their relationship was rocky and Sharita eventually began seeing someone else and even moved out of the city and into a Detroit suburb to get away. However, he refused to leave her alone, Williams-Hill said.

Police and arson investigators on Tuesday interviewed people who worked in the building and relatives of Sharita Williams and the maintenance man.

Blackmon could not confirm whether the two had been in a relationship.

British 'test tube baby' pioneer Robert Edwards dies

LONDON (Reuters) - Robert Edwards, a British Nobel prize-winning scientist known as the father of IVF for pioneering the development of "test tube babies", died on Wednesday aged 87 after a long illness, his university said.

Edwards, who won the Nobel prize for medicine in 2010, started work on developing in-vitro fertilization (IVF) in the 1950s, and the first so-called test tube baby, Louise Brown, was born in 1978 as a result of his research.

Since then, more than 5 million babies have been born around the world as a result of the techniques Edwards developed together with his late colleague, Patrick Steptoe.

Edwards, who has five daughters and 11 grandchildren, said he was motivated in his work by a desire to help families.

"Nothing is more special than a child," he was quoted by his clinic as saying when he won his Nobel prize.

Edwards began his work on fertilization in 1955, and by 1968 had managed to fertilize a human egg in a laboratory. He then started to collaborate with Steptoe.

In 1980, the two founded Bourn Hall, the world's first IVF clinic, in Cambridge, eastern England, where gynecologists and cell biologists around the world have since come to train.

Mike Macnamee, chief executive of the clinic, said Edwards was "one of our greatest scientists", whose inspirational work had led to a breakthrough that had enhanced the lives of millions of people worldwide.

CRITICISM AND CONTROVERSY

IVF is a process by which an egg is fertilized by sperm outside the body in a test tube, giving rise to the term "in vitro" or "in glass".

Experts say that today, as many as 1 to 2 percent of babies in the Western world are conceived through IVF, a method designed to help infertile couples or those who have trouble conceiving naturally but who want to have children of their own.

Yet Edwards' work and its consequences remain controversial. The Roman Catholic Church strongly opposes IVF as an affront to human dignity that destroys more human life than it creates - because scientists discard or store unused fertilized embryos.

Working together in the 1960s and 1970s, Edwards and Steptoe, a gynecologist, pursued their research despite opposition from churches, governments and many in the media, and skepticism from scientific colleagues.

They struggled to raise funds and had to rely on private donations, but in 1968 they developed methods to fertilize human eggs outside the body.

Working at Cambridge University, they began replacing fertilized embryos into infertile mothers in 1972. But several pregnancies spontaneously aborted due to what they later discovered were flawed hormone treatments.

PRECISE TIMING

In 1977, they tried a new procedure, which did not involve hormone treatments but relied instead on precise timing. On July 25 of the following year, the world's first IVF baby was born.

Peter Braude, a professor of obstetrics and gynecology at King's College London, said few biologists had been able to have such a positive and practical impact on humankind.

"Bob's boundless energy, his innovative ideas, and his resilience despite the relentless criticism by naysayers changed the lives of millions of ordinary people who now rejoice in the gift of their own child," he said.

"He leaves the world a much better place."

According to the European Society of Human Reproduction and Embryology (ESHRE), around one in six couples worldwide experience some form of infertility problem at least once during their reproductive lifetime.

Since Edwards' pioneering work, various forms of "assisted reproductive technology" have been developed, including intracytoplasmic sperm injection (ICSI) - a process by which an egg is fertilized by injecting it with a single sperm.

Anna Veiga, ESHRE's chairman, said calculations last year indicated there were now 5 million IVF babies in the world. "And they each reflect the sacrifices (Edwards) made to establish IVF as a legitimate treatment in world medicine," she said.

Is the End Near for JCPenney? | Breakout - Yahoo! Finance

Troubled merchant JCPenney (JCP) last night announced that CEO Ron Johnson would be leaving effective immediately. The move comes at a critical time for the company.

During his short term as CEO Ron Johnson managed to alienate JCP?s former customer base before he was able to implement a plan to attract new shoppers. The results have been disastrous. During the critical fourth-quarter of 2012, same-store sales (revenues at stores open more than a year) fell by 32%. Roughly half of the 1,100 JCP store base has been updated to fit Johnson?s turnaround vision while the others are going through costly remodels. In human terms Johnson fired or laid-off 19,000 employees. The math works out to about 40 jobs lost every day of Johnson?s 15-month term.

The clock is ticking on the 111-year old chain. If JCP runs through cash at the rate it has over the last 12 months the company will have no money on the balance sheet by sometime this summer, exactly at the time retailers need to maximize their borrowing to be in stock for the holidays.

If the new CEO can?t stop the bleeding JCPenney will be bankrupt by Labor Day. The question for investors and shoppers alike is who is the new boss and what, if anything, can he do to save the company.

The New Boss is Same as the Old Boss

The job of cleaning up the mess now falls to Myron Ullman, the very man JCP?s board of directors jettisoned to make room for Ron Johnson in the first place. Brian Sozzi, retail stock whiz and CEO of Belus Capital Advisors, thinks bringing back Ullman is a big mistake.

?JCP just took a step back in time in trying to bring back old school retailing 101 where you promote every weekend,? he explains in the attached video. Among the daunting challenges with going back to the old strategy is that JC Penney?s just spent 15 months telling its former customers they were no longer welcome at the hip new JCP.

Sozzi says Ron Johnson ?essentially told the entire Baby Boom class ?hey, you have a lot of spending power (but) we don?t want you.'?

The problem facing Myron Ullman is that he?s got half of JCP?s 1,100 stores partially remodeled, a customer base that has no idea what the store stands for anymore, and a massive amount of incoming inventory specifically bought to fit into the younger, hipper demographic Johnson was trying to woo.

Just for good measure Ullman also has a company rapidly running out of cash, having burned through nearly a billion dollars of liquidity in 2012.

What Should Customers Expect at the New-New JC Penney?s?

Option 1: Undo everything Johnson did and go back to the JC Penney of old.

Ullman could theorhetically mark down all the merchandise associated with the ?new? JC Penney via deep discounts and recreate the shopping experience customers had come to expect. Sozzi thinks Ullman would be making a disastrous mistake. ?If he does that in the next couple months JC Penney will no longer be in business,? he states without a trace of doubt.

JC Penney took deep discounts to reduce inventory and generate cash flow at the end of 2012. Most of the goods that would need to be marked down to go back to the old merchandising strategy haven?t even arrived at the remodeled stores. Retailers order goods months ahead of time, meaning most of what JCP had intended to sell as part of back to school has already been purchased.

If the company starts marking down that merchandise now its financing will dry up immediately. Whatever else they do JCP can?t go home again.

Option 2: Stick with Ron Johnson?s plan.

Suffice it to say the board of directors is unlikely to implement Johnson?s vision considering the decisiveness with which they just fired the man.

Option 3: Split into two chains.

Strangely enough, the fact that Johnson barely got halfway through his planned remodels before getting fired may be the best thing Ullman has going for him. Abandoning the need to dedicate resources to bringing the legacy stores up to speed could buy some time with the vendors and allow the company to operate both the hip JCP locations and the tired JC Penney?s as separate entitles.

Sozzi doesn?t think such a move eliminates Ullman?s need to spend on the ?500 zombie stores that Johnson didn?t show any love to? but reduces the sense of urgency on that spending.

Breaking JCP into two different divisions is also a way to acknowledge the current reality as Sozzi sees it. ?That?s the ultimate message coming off of Ron Johnson that he split this company in half and nobody even realizes yet,? he says.

Exclusive: Beyonce, Jay-Z Cuba visit had U.S. Treasury Department OK - source

MIAMI (Reuters) - A visit by American pop star Beyonce and rapper husband Jay-Z to Havana last week was a cultural trip that was fully licensed by the U.S. Treasury Department, a source familiar with the itinerary said on Monday.

The longstanding U.S. trade embargo against Cuba prevents most Americans from traveling to the communist-led island without a license granted by the U.S. government.

Three Cuban-American members of Congress, all Republicans from Miami and supporters of a firm stance on Cuba, have asked the Treasury Department to look into the licensing of the trip, prompting officials to seek more information from the organizers.

Beyonce and Jay-Z celebrated their fifth wedding anniversary in Havana and were greeted by big crowds as they strolled through the Cuban capital. The music industry power couple were instantly recognized as celebrities despite the past half-century of ideological conflict that separates the two countries.

The source told Reuters that the trip included visits with Cuban artists and musicians, as well as several nightclubs where live music was performed, and some of the city's best privately run restaurants, known as "paladares."

The visit was planned as a "people-to-people" cultural visit and involved no meetings with Cuban officials, or typical tourist activity such as trips to the beach, the source said. Even a walk around the Old City of Havana, mobbed by crowds of excited Cuban spectators, was led by Miguel Coyula, one of the city's leading architects.

Publicists for the couple did not return emails or phone calls seeking comment.

Beyonce and Jay-Z were the latest American stars, joining actors Bill Murray, Sean Penn and James Caan who have also visited the Caribbean island in the past few years. But the pair were the first to cause such a stir everywhere they went.

The couple arrived in Havana unannounced for a four-day visit on Wednesday on a flight from Miami. But word of their presence spread like wildfire, by text messaging and word of mouth.

Beyonce, who sang at President Barack Obama's inauguration for his second term in January, was instantly recognized when she and Jay-Z, and their mothers, dined at La Guarida, the city's top privately run restaurant, on their first night.

The next day a crowd of several thousand people swarmed around them in Old Havana during a walk-about.

They also visited a children's theater group and several clubs where they heard live music, and occasionally took to the dance floor. On Friday, they toured Cuba's top art school and met with some young artists.

GOVERNMENT PROPAGANDA

U.S. Representatives Ileana Ros-Lehtinen and Mario Diaz-Balart questioned the couple's trip, saying it was being used for Cuban government propaganda. Ros-Lehtinen, long a fierce critic of the Cuban government, said it was "very disconcerting that these two mega stars would go down to Cuba and vacation as if they were in a tropical paradise and not say one word about the brutality their hosts display against all pro democracy activists."

Florida Senator Marco Rubio said the Obama administration's cultural exchange programs "have been abused by tourists."

If the Treasury Department had licensed the trip "the Obama Administration should explain exactly how trips like these comply with U.S. law and regulations governing travel to Cuba," Rubio said.

The Cuban government was unaware of the participants on the trip until shortly before they departed for Cuba, the source told Reuters, adding that the Cuban media made no official mention of the pair while they were in Havana, at the request of the singers.

The U.S. Treasury Department's Office of Foreign Assets Control, which handles licenses for travel to Cuba, said it does not comment on individual cases.

OFAC provides licenses to visit Cuba on a case-by-case basis for educational exchanges, and for programs that promote "people-to-people contact" and "contribute to the development of civil society in Cuba," according to Treasury Department guidelines. Tourism is specifically prohibited by the guidelines, it states.

"It's hard to imagine a more people-to-people contact visit than the scenes witnessed last week on the streets of Havana with two of the United States' biggest music stars wading through crowds of fans they never knew they had," said John McAuliff, executive director for the Fund for Reconciliation and Development, an organization working to normalize U.S. relations with Cuba.

He described the couple's program as "characteristic of licensed trips undertaken by thousands of Americans every year."

While it has kept the embargo in place, the Obama administration has eased restrictions on travel to Cuba for academic, religious or cultural programs.

"People-to-people" visits, first promoted under President Bill Clinton in the 1990s, but reined in under President George W. Bush, have been revived by the Obama administration to encourage more contact between Americans and Cubans, separated by just 90 miles of ocean, but over half a century of ideological differences.

A number of U.S. firms are sponsoring Cuba trips, ranging from National Geographic to the Metropolitan Museum of Art in New York to the American Automobile Association, resulting in a steadily growing stream of Americans to the island.

Only licensed travelers and Cuban-Americans visiting relatives on the island are allowed to board special charter planes from Miami for the 50-minute flight to Cuba.

Some U.S. citizens dodge those requirements by traveling to Cuba via third countries. Cuba does not stamp the passports of Americans who visit Cuba, making it easy to avoid detection.

Criminal penalties for violating OFAC regulations range up to 10 years in prison and $250,000 in individual fines.

(AP) ? Kim Kardashian's upcoming divorce trial will be a family affair, but her attorneys do not expect to call her famous sisters to testify about the reality star's brief marriage to NBA player Kris Humphries.

But Kris Jenner, Kardashian's mother, and several lawyers and managers are expected to testify about the pair's relationship and prenuptial agreement, according to a witness list filed Monday in Los Angeles.

Humphries is seeking an annulment of the pair's 72-day marriage, claiming it was based on fraud. Kardashian wants a judge to enter a divorce judgment instead and has denied accusations that she married Humphries for the sake of her reality shows.

She will testify that she "did not defraud (Humphries) into marrying her," the filing by Kardashian's legal team states.

Kardashian's boyfriend, Kanye West, and her sisters Kourtney and Khloe are not listed as probable witnesses.

Kardashian and West, who has been deposed in the case, are expecting a baby in July. Humphries' lawyers attempted to serve West a deposition subpoena disguised in a Nordstrom's box last year, just one of the incidents that have contributed to acrimony between Kardashian and Humphries since she filed for divorce in October 2011.

Humphries, a power forward for the Brooklyn Nets, and Kardashian were married at a lavish, star-studded ceremony that was televised by E! Entertainment Television. The network also airs "Keeping Up With the Kardashians" and several spinoff shows based on the family's activities.

Humphries' lawyers have not yet filed their witness list.

The former couple is scheduled to appear in a Los Angeles court on Friday to try to settle the case in advance of a May 6 trial date.

Oil price little changed ahead of earnings, Fed

The price of oil was little changed on Monday, as traders awaited the start of the quarterly corporate earnings season and the latest word from the Federal Reserve on the economy.

Benchmark oil for May delivery was up 41 cents to $93.11 a barrel on the New York Mercantile Exchange in afternoon trading.

Alcoa kicks off the first-quarter earnings season after the stock market closes Monday. Analysts expect the aluminum giant to report slightly lower earnings compared to a year ago. Overall, Wall Street is looking for improved earnings from many companies as the economy shows signs of strengthening.

The minutes from the Federal Reserve's last meeting will be released Wednesday afternoon. That may give investors more insight into the central bank's view of the economy and prospects for the Fed's bond-buying stimulus program to continue at its current pace.

At the gas pump, drivers continued to get some relief. The national average for a gallon of regular was $3.59, down 4 cents from a week ago and about 34 cents lower than a year ago.

Brent crude, which sets the price of oil used by many U.S. refineries to make gasoline, fell 24 cents to $103.88 per barrel on the ICE Futures exchange in London.

In other energy futures trading on the Nymex:

? Heating oil rose 3 cents to $2.94 per gallon.

? Wholesale gasoline rose 4 cents to $2.90 per gallon.

? Natural gas fell 6 cents to $4.06 per 1,000 cubic feet.

The bipartisan budget recently passed in New York includes a massive raid of the State Insurance Fund, the state?s workers? compensation carrier of last resort. When I first heard about it a few weeks ago I was unable to find any coverage of it by the media, but now The Wall Street Journal has picked up on it.

New Yorkers have been treated this week to almost daily political perp walks, as a parade of office-holders have been rung up for bribery and other crimes. The big news here is that they were caught. The bigger scandal in the Empire State continues to be what the politicians do that?s legal.

Witness Governor Andrew Cuomo?s $1.75 billion raid of the state?s workers compensation fund to finance more spending. This year?s budget expropriates $500 million from the State Insurance Fund for a ?transformative capital? program?details still to come?and $1.25 billion to cover general fund expenses through 2016. Tapping off-balance sheet accounts is an old budget trick, but Mr. Cuomo has added some creative twists.

During the 1980s and early ?90s, Albany swiped $1.3 billion from the State Insurance Fund, which is supposed to be the insurer of last resort for small businesses that can?t obtain affordable policies on the private market. The state issued the fund an IOU, which remains on the fund?s balance sheet as an asset though realistically it?s worth about as much as the Argentine peso.

In 1983 Brooklyn?s Methodist Hospital sued the state for seizing policyholders? premium money without due process or just compensation. New York?s high court ruled in favor of the state, holding that the insurer was a state agency and not a mutual insurance pool. Report points to worldwide rise in anti-Semitic incidents

A report by Tel Aviv University and the European Jewish Congress found a 30 percent jump in anti-Semetic violence and vandalism in 2012. Researchers saw a correlation between extreme right-wing parties and high levels of anti-Semitic incidents in certain countries.

Following a two-year decline in the figures, the annual report on worldwide anti-Semitic incidents recorded 686 attacks in 34 countries, ranging from physical violence to vandalism of synagogues and cemeteries, compared to 526 in 2011. The report was issued at Tel Aviv University, in cooperation with the European Jewish Congress, an umbrella group representing Jewish communities across Europe.

The report linked the March 2012 shooting at a Jewish school in Toulouse, where an extremist Muslim gunman killed four, to a series of copycat attacks, particularly in France, where physical assaults on Jews almost doubled.

Researchers who presented the report at the university on Sunday said they had also found a direct correlation between the strengthening of extreme right-wing parties in some European countries and high levels of anti-Semitic incidents, as well as attacks on other minorities and immigrants.

They said Europe's economic crisis was fueling the success of parties like Jobbik in Hungary, Golden Dawn in Greece and Svoboda in Ukraine.

Moshe Kantor, the president of the European Jewish Congress, called for strong action by the European Union, charging that governments ? particularly Hungary ?were not doing enough to curb these parties' activities and protect minorities.

"Neo-Nazis have been once again legalized in Europe, they are openly sitting in parliaments," said Moshe Kantor, the president of the European Jewish Congress.

Golden Dawn swept into Greece's parliament for the first time in June on an anti-immigrant platform. The party rejects the neo-Nazi label but is fond of Nazi literature and references. In Hungary, a Jobbik lawmaker has called for Jews to be screened as potential security risks. The leader of Ukraine's Svoboda denies his party is anti-Semitic but has repeatedly used derogatory terms to refer to Jews.

The report by the university's Center for the Study of Contemporary European Jewry found little correlation between the increase of anti-Semitic attacks and Israel's military operation in Gaza in November. While there was a spike in incidents at the time, it was much smaller in number and intensity than the one that followed the Toulouse attack, said Roni Stauber, the chief researcher on the project.

"This shows that the desire to harm Jews is deeply rooted among extremist Muslims and right-wingers, regardless of events in the Middle East," he said.

The release of the report was timed to coincide with Israel's Holocaust Remembrance Day, which was starting Sunday at sundown.

Israel says it weathers cyber attack campaign

JERUSALEM (Reuters) - A pro-Palestinian cyber attack campaign was launched against Israeli government websites on Sunday but did not cause serious disruption, an Israeli statement said.

Over the weekend, email messages and websites using the name of the Anonymous hacking group said a campaign had been launched in solidarity with the Palestinian people to "erase Israel from cyberspace" on Sunday.

"As of midday, Israeli government websites are accessible to the public, as they were for the entire weekend," a Treasury Ministry statement said.

Attempts by Reuters in Jerusalem to access the websites of Israeli government ministries, the police and central statistics bureau were successful.

Yitzhak Ben Yisrael, who founded the government's Cyber Bureau two years ago, told Israel Radio there had been some disruptions to several websites, such as the Education Ministry, whose security protocols had yet to be updated.

The Cyber Bureau was established to ward off hacking attacks on Israel's key networks.

"They have not managed to disrupt even one website that has been protected (by the bureau) - the really important sites," Ben Yisrael said.

The statement issued by the Treasury said the Education Ministry's website had not been accessible during the weekend due a "technical fault".

The website was back on line on Sunday afternoon.
